Terms of Use

Welcome to Fetchin, a product provided by Groupe PAMART, a SASU registered in France (“Groupe PAMART,” “we,” “us,” or “our”). These Terms of Use (“Terms” or “Agreement”) govern your access to and use of our data enrichment APIs, websites, platforms, and related services (collectively, the “Services”).

Fetchin provides APIs and tools for accessing and enriching publicly available professional and business information. These Terms apply to all users of the Services, including both free and paid accounts.

Please read these Terms carefully. By accessing or using any part of the Services, you (“you,” “your,” or “User”) agree to be bound by these Terms and our Privacy Policy, which is incorporated by reference. If you do not agree, you may not access or use the Services.

1. Acceptance of Terms

By accessing, using, registering for, or purchasing any part of the Services, you agree to these Terms and our Privacy Policy. If you do not agree, you may not use the Services.

If you are using the Services on behalf of a company, organization, or other legal entity (an “Entity”), you represent and warrant that you are authorized to bind that Entity to these Terms. In that case, “you” and “your” refer to the Entity.

You acknowledge that these Terms constitute a binding contract between you and Groupe PAMART, even though it is electronic and not physically signed.

2. Description of Services

Groupe PAMART, through its product Fetchin, provides data enrichment services which may include, but are not limited to: professional profile enrichment, company data enrichment, people search, post retrieval, API access to professional datasets, data verification, and analytics.

The specific Services available to you may depend on your subscription plan. We reserve the right to update, modify, enhance, or discontinue features or functionalities of the Services at our sole discretion, with or without notice, unless otherwise required by applicable law or your specific agreement with us.

3. User Accounts & Responsibilities

3.1 Account Creation

To access certain features of the Services, you must register for an account. You must be at least 18 years of age and have the legal capacity to enter into this Agreement. You agree to provide and maintain true, accurate, current, and complete information during registration.

3.2 Account Security

You are solely responsible for maintaining the confidentiality of your account credentials, including your password and API keys. You are responsible for all activities that occur under your account or through the use of your credentials, whether or not authorized by you. You must notify us immediately at nicolas@fetchin.io if you become aware of any unauthorized use of your account.

3.3 API Key Management

API keys issued to you are personal and non-transferable. You must not share, publish, or expose your API keys in client-side code, public repositories, or any publicly accessible location. We reserve the right to revoke API keys that we reasonably believe have been compromised.

4. Acceptable Use

You agree to use the Services only for lawful purposes and in accordance with these Terms. You must not:

• Use the Services to violate any applicable local, national, or international law or regulation.
• Use the data obtained through the Services for unsolicited bulk communications (spam), harassment, discrimination, or any unlawful purpose.
• Attempt to circumvent rate limits, usage quotas, or other technical restrictions.
• Reverse engineer, decompile, or disassemble any part of the Services.
• Resell, redistribute, or sublicense access to the Services or the data obtained through them without our prior written consent.
• Use automated means to access the Services beyond the intended API interfaces.
• Interfere with or disrupt the integrity or performance of the Services.

You are responsible for ensuring that your use of the data obtained through our Services complies with all applicable data protection laws, including the GDPR and any applicable local regulations.

5. Fees & Payment

5.1 Pricing

Certain features of the Services are available under free and paid subscription plans. Current pricing is available on our Pricing page. We reserve the right to change our pricing at any time, with reasonable notice for existing subscribers.

5.2 Billing

Paid subscriptions are billed in advance on a monthly basis. Pay-as-you-go usage is billed based on actual API calls consumed. All fees are exclusive of applicable taxes unless stated otherwise.

5.3 Refunds

Fees are non-refundable except as required by applicable law. If you cancel a subscription, you will retain access to the paid features until the end of your current billing period.

6. Intellectual Property

All rights, title, and interest in and to the Services, including all software, APIs, documentation, trademarks, and content, are and shall remain the exclusive property of Groupe PAMART. These Terms do not grant you any right to use our trademarks, logos, or brand features without prior written consent.

You retain ownership of any data you submit to the Services. By using our APIs, you grant us a limited license to process your submitted data solely for the purpose of providing the Services.

7. Privacy & Data Protection

7.1 Privacy Policy

Our collection, use, and protection of personal data is governed by our Privacy Policy, which is incorporated by reference into these Terms.

7.2 Data Processing Agreement (DPA)

If your use of the Services involves us processing personal data on your behalf where you are the data controller, and such processing is subject to the GDPR, CCPA, or similar laws, you may request a Data Processing Agreement (DPA) by contacting us at nicolas@fetchin.io.

7.3 Your Compliance Obligations

You are responsible for ensuring that your use of data obtained through the Services complies with all applicable privacy and data protection laws, including obtaining any necessary consents or providing any required notices to data subjects.

8. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES AND ALL DATA PROVIDED THROUGH THEM ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, COMPLETENESS, OR NON-INFRINGEMENT.

We do not warrant that the Services will be uninterrupted, error-free, or secure, or that any data provided will be accurate, complete, or current at all times.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL GROUPE PAMART BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITIES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE GREATER OF (I) THE TOTAL FEES ACTUALLY PAID BY YOU TO GROUPE PAMART DURING THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO LIABILITY, OR (II) ONE HUNDRED EUROS (€100.00).

10. Indemnification

You agree to indemnify, defend, and hold harmless Groupe PAMART, its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Services; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; or (d) your infringement of any third-party rights.

11. Termination

We may suspend or terminate your access to the Services at any time, with or without cause, with or without notice. You may terminate your account at any time by contacting us or through your account settings. Upon termination, your right to use the Services ceases immediately. Sections that by their nature should survive termination shall survive, including Sections 6, 8, 9, 10, and 12.

12. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of France, without regard to its conflict of law provisions. Any disputes arising out of or relating to these Terms or the Services shall be submitted to the exclusive jurisdiction of the courts of Arras, France.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on our website with a revised effective date. Your continued use of the Services after the effective date of any changes constitutes your acceptance of the revised Terms.
